This MarketSmart Code of Conduct Policy (the “Code of Conduct”) outlines the rules of acceptable conduct for all your interactions with other users of the MarketSmart online learning services (the “Services”). By using the Services, you can interact with other users in the online community of users that have also purchased an account for the Services (the “Community”) and participate in a series of live question and answer sessions with other users of the Services (collectively, the “Interactive Areas”). This Code of Conduct forms a part of the Terms of Service and is incorporated by reference in the Terms of Service. By using the Services or participating in the Community, you agree that you have read and agree to comply with this Code of Conduct.
This Code of Conduct sets forth the rules that MarketSmart expects all users to follow to ensure a successful and productive experience for all users of the Services in the Interactive Areas. All users are responsible for exercising good judgement when interacting with other users in the Interactive Areas. This Code of Conduct is in place to protect you, other users of the Services and MarketSmart. This Code of Conduct applies to all users of the Services that interact with other users in the Interactive Areas.

When interacting with other users of the Services in the Interactive Areas, you are prohibited from undertaking, and agree not to:

You may not post, upload, or transmit to or otherwise make available in the Interactive Areas any content, communications, or other information:
You should take all necessary steps to prevent making Unauthorized Content available in the Interactive Areas.
c. Behavior with other Users
Do not harass, stalk or bully other users in the Interactive Areas. For example, don’t engage in self-harm; scream at or intimidate other users, or violate another user’s privacy (i.e. share another user’s personal information).
You agree to use caution in all interactions with other users if you decide to communicate off the Services, or meet in person. You understand that we do not conduct criminal or other background checks on users, or otherwise inquire into the background of our users. We make no representations or warranties about the conduct of users. Enforcement of the user content or conduct rules set forth in this Code of Conduct is solely at our discretion, and failure to enforce such rules in any instance does not constitute a waiver of our right to enforce such rules in any other instance.
We may suspend or stop providing our Services to you if you do not comply with this Code of Conduct or policies, if you post, upload, or transmit to or otherwise make available Unauthorized Content in any Interactive Area, or if we are investigating suspected misconduct, or for any other reason. Upon receiving a permanent suspension, you will forfeit all rights to access the Services and interact in the Interactive Areas.
If you witness any user of the Services acting in violation of this Code of Conduct, please report the prohibited conduct by filing a complaint to the following email address: mwoodward@imarketsmart.com. MarketSmart may, but is not obligated to, investigate and take action based on complaints it receives from any user.
This Code of Conduct does not create any obligation for us to ensure that the Interactive Areas will not contain any content that is prohibited by this Code of Conduct, or any liability for our failure to do so. As a provider of interactive services, we are not liable for any statements, representations, or content provided by our users, including in the Interactive Areas. We do not have any obligation to screen, edit, or monitor any of the content posted in the Interactive Areas. However, we reserve the right to monitor, and we have absolute discretion to screen, remove, and/or edit, any content posted or stored in the Interactive Areas, at any time and for any reason, with or without notice.
We may modify this Code of Conduct or any additional terms that apply to any Interactive Area for any reason, for example, to reflect changes to the law or changes to the MarketSmart Services and the Interactive Areas. You should look at this Code of Conduct regularly and the “Last Updated” date at the beginning of this Code of Conduct. We’ll use reasonable efforts to give you notice of these modifications, such as posting notice of modifications to this Code of Conduct on this web page, through the Interactive Areas, or via email. By continuing to use the Interactive Areas after we make these modifications, you agree that it will be subject to the modified Code of Conduct. If you does not agree to the modified Code of Conduct for the Interactive Areas, you should discontinue its use of it.
In the event of any conflict or inconsistency between this Code of Conduct and the Terms of Service with respect to Interactive Areas, this Code of Conduct shall prevail solely with respect to the Interactive Areas.
